Filing For A DePuy Complaint Is Important
A multidistrict litigation under federal District Court Judge David Katz of the Northern District of Ohio in Toledo consolidating all hip replacement recall related lawsuits was successfully done by DePuy Orthopaedics. This MDL has been moving efficiently despite the intial status conference being delayed for a month. Judge Katz ordered each plaintiff to file a short-form complaint while requiring DePuy to file a single master abbreviated or short-form answer on April 5, 2011. The order, Amended Case Management Order No. 4, allows plaintiffs to claim damages under 23 specific causes of action which includes malice and violation of state consumer protection statutes. Plaintiffs can also write in others if they wish like claiming for damages such as loss of services and loss of consortium.
An allowance of 32 separate defenses were made by DePuy’s master answer. Punitve damages are retained from DePuy’s pleadings in the first hip replacement lawsuits and address limitations of damages although it is not limited to that.
